Please read these Terms & Conditions carefully as they are the terms governing your use of the Valident service (“the service”). We provide the service only on these Terms & Conditions and if you do not agree to be bound by them you may not use the service. By registering to use the service you will be deemed to accept these Terms & Conditions.  Valident is a Registered Trade Mark belonging to and administered by Dentsure Ltd.

We care very much about the standard of the service, and we want to hear from you if you are not satisfied in any way. Please send your comments to info@valident.co.uk .

 1. Your obligations to us

You agree to provide accurate and complete information to us when registering to use the service. You agree that you will comply with any reasonable instructions or directions issued by us from time to time concerning access to the service and that you will only use the service in a manner consistent with these Terms & Conditions. You agree that you will not use the service for any unlawful purpose or in breach of any applicable law or regulation. In particular you will not use the service to commit any criminal act or any act constituting infringement of any intellectual property right, or to transmit any material that is blasphemous, obscene, indecent or pornographic or which is of a defamatory, offensive, abusive, or menacing character or which may cause annoyance, inconvenience or needless anxiety to any person. We reserve the right to remove any material from the service that we at our sole discretion find objectionable. This may include the posting of any inaccurate information or any information about someone other than you. We reserve the right to end your access to the service at any time if you are in breach of these Terms & Conditions.

You agree to pay us for your use of the service in the manner agreed with us in advance. Our invoices are payable within 14 days of the date of invoice. We will contact you to give 7 days notice in the event of overdue payment and reserve the right to disconnect the service thereafter if necessary.

You agree to indemnify us against all losses (including, without limitation, legal costs) we may incur as a result of any breach by you of these Terms & Conditions.

2. Our obligations to you

We will provide you with the rights to use the Valident service that is provided by the form of the account that you have opened with us. The Valident service is only available to customers who are Dental Care Professionals Registered with the General Dental Council and who are also Registered with the Information Commissioner (ICO).

We will observe all relevant UK data protection legislation in relation to the personal data you provide to us on registration and will only use it for authorized purposes. We will provide the service to you with reasonable care and skill and will use our best endeavours to maintain continuity of service. However, we cannot guarantee that the service will be continuous or error free. We do not accept liability for any special loss or any indirect or consequential loss of any nature (including without limitation any economic loss or other loss of business, production, revenue, profit, goodwill or anticipated savings), whether arising in contract, tort, negligence, breach of statutory duty or otherwise, and whether or not the possibility of such loss arising has been brought to our attention.

We do not monitor your use of the service but we reserve the right to do so. We take no responsibility for material that has not been introduced by us. You acknowledge that you are solely responsible for the form, content and accuracy of any material introduced by you in accordance with your professional regulations issued from time to time by the General Dental Council and the Information Commissioner’s Office.

Whilst we take all reasonable care in providing the Valident service, you contract with others through the service at your own risk and we make no representation as to whether you will be satisfied with what others provide to you.

3. Disclaimer

Regulatory Compliance

Dental Practice websites giving access to electronic communications networks are the subject of EU Directives and UK Statutory Instruments 2013 2002 and 2426 2003 concerning the provision of information/communications services via the Internet. The devolved authorities for implementing the legislation in the UK are the General Dental Council (GDC) and the Information Commissioner’s Office (ICO). Details of this legislation as it applies to the dental profession can be found at www.valident.co.uk under “Compliance Issues”

The Care Quality Commission (CQC) is responsible for ensuring that dental practices themselves recognize and implement all the laws that apply to the practice of dentistry in the UK.

The Valident service has been designed to introduce compulsory website fields that draw attention to specific areas of regulatory compliance. New client websites will not be published on the Practice Search Internet Directory until the compulsory fields have been completed and published. It is the responsibility of the client (preferably the Practice Principal) to ensure the veracity of website information and that the practice website fulfils all of the compliance regulations applying to the publication of dental practice websites on the Internet. The Valident Regulatory Compliance service is a branded accreditation service that ensures all of the regulatory compliance requirements in respect of the GDC/CQC/ICO have been fulfilled at the date of the Valident accreditation, It is the responsibility of the Practice Webmaster to ensure that whilst the practice website remains published on the Internet it also remains compliant with the online regulations that apply to the practice of dentistry

4. Electronic Communications

The dental profession has a special duty of confidentiality to ensure that personal patient data are properly protected. Many e-mail services do not provide the necessary security protection and Valident e-messaging services have been designed for professional use. All Valident e-communications are sent and stored in encrypted format and we will seek customer consent to access encrypted client data in the event of an emergency or in response to a lawful request for disclosure.

5. The Valident Website Accreditation Service

All registered users (Subscribers) of the Valident services must be registered with the General Dental Council (GDC) and the Information Commissioner’s Office (ICO). Their dental practice must be registered with the CQC and remain so during the term of the Valident Licence. The Licence entitles the customer to display the Valident Website Compliance Logo at the dental practice website address (URL) displayed on the Certificate.

6. General

We reserve the right at any time, in our sole discretion, to make any changes to these Terms & Conditions. Any changes will be notified to you by e-mail or by publishing the revised Terms & Conditions on the Valident.co.uk website. By continuing to use the service you agree to be bound by such changes. These Terms & Conditions are to be interpreted in accordance with English law and, in the event of any dispute, you and we irrevocably submit to the non-exclusive jurisdiction of the English Courts. Finally, nothing in these Terms & Conditions is to be interpreted as an attempt to limit or exclude our liability for any personal injury resulting from our negligence, and if you are a consumer, nothing we say affects your statutory rights.
